Terms of Service

1. Agreement
These Terms of Service ("Terms") are an agreement between you and Enchanted Connections ("Enchanted Connections", "we", "us") and govern your use of the Enchanted Connections app and services. By creating an account you accept these Terms together with our Privacy Policy, Community Guidelines and Safety Guidelines. If you do not agree, please do not use Enchanted Connections. If you use Enchanted Connections for an organization, you confirm you are allowed to accept these Terms for it.
2. Who may use Enchanted Connections
Enchanted Connections is for adults aged 18 and over. You must be 18 or older to create an account and to keep using one. You agree to provide accurate information about yourself, to keep one account in your own name, and not to impersonate anyone. Accounts are personal and cannot be sold or transferred. If we learn that a member is under 18, we will close the account and delete its data.
3. Your account
You are responsible for keeping your password confidential and for all activity on your account. Tell us promptly if you believe someone else has access to it. We may ask you to verify your email address, and we may suspend or close accounts that break these Terms.
4. Membership and payment
Most Enchanted Connections features require an active paid membership, currently US$9.99 per month or US$110 per year, billed through our payment provider Stripe. The Subscription Terms, Cancellation Policy and Refund Policy below form part of these Terms.
5. Your content
You keep ownership of the photos, text and other content you add. You give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display that content to operate and promote the service. You confirm you have the rights needed to share it, that it does not infringe anyone else's rights, and that it follows our Community Guidelines. We may remove content that breaks these Terms. Please keep sensitive personal details out of anything public.
6. Member conduct
You agree to follow our Community Guidelines. In particular you will not harass, threaten, defame or deceive anyone; post hateful or discriminatory content; post sexual content or send unwanted sexual attention; involve minors; impersonate anyone; send spam, scams, chain messages or requests for money; share another person's private information; collect member data by automated means; use bots, scrapers or scripts; attempt to access accounts or systems you do not own; use the service for unlawful purposes; or open new accounts to get around a suspension.
7. Meeting members in person
Enchanted Connections helps adults find each other. We do not organize, host, supervise, insure, vet or guarantee any meetup, trip or in-person encounter. You alone decide whether, when and where to meet another member, and you do so at your own risk. Read the Safety Guidelines before any in-person meeting.
8. Other members and third parties
We do not run criminal background checks, verify identity documents, or confirm that information members give us is accurate. Profiles and messages are created by members and may be inaccurate or misleading. We are not responsible for the conduct of any member, online or in person, and we do not guarantee that you will find friends, a companion, a match or a travel partner.
9. Moderation and enforcement
We review reports and may remove or hide content, limit features, or suspend or close accounts that break these Terms or harm the community. We are not obliged to monitor all content, and we are not obliged to remove any particular content. Serious cases, such as threats, minors, or fraud, may be handled without prior warning.
10. Not affiliated with Disney
Enchanted Connections is an independent fan community. We are not affiliated with, sponsored by, endorsed by or connected to The Walt Disney Company or any of its subsidiaries, parks, resorts or affiliates. Park, resort and destination names are used descriptively to help members talk about the places they love. We are not a travel agency and we do not sell tickets, passes, accommodation or travel packages. All third-party names and marks belong to their owners.
11. Third-party services
We rely on third parties to run Enchanted Connections, including Stripe for payments and cloud providers for hosting, storage, messaging and email. Their own terms and privacy policies apply to the services they provide, and we are not responsible for their acts or omissions.
12. Availability and changes to the service
The service is provided on an "as is" and "as available" basis. Features may be added, changed, suspended or discontinued, and the service may be unavailable during maintenance or because of events outside our control. We do not promise uninterrupted, secure or error-free operation, and we may set reasonable limits on use.
13. Disclaimers
To the fullest extent permitted by law, Enchanted Connections is provided without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement. We make no warranty about the accuracy of member information, the conduct of members, or any particular outcome from using the service.
14. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill or opportunities, arising out of or relating to your use of Enchanted Connections or your interactions with any member, whether based in contract, tort, negligence, strict liability or otherwise. Our total liability for all claims relating to the service in any twelve (12) month period is limited to the greater of the amount you paid us in that period or US$50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here excludes liability that cannot lawfully be excluded.
15. Indemnity
You agree to indemnify, defend and hold harmless Enchanted Connections and its owners, officers, employees, contractors and agents from any claim, loss, liability, cost or expense, including reasonable legal fees, arising out of your use of the service, your content, your interactions with other members, or your breach of these Terms or of another person's rights.
16. Ending your account
You may close your account at any time from Profile and then Delete account, and cancel your membership first so billing stops. We may suspend or close your account if you break these Terms, if we are required to by law, or if keeping the account would put others at risk. Sections that by their nature should survive termination, including payment obligations, disclaimers, limitation of liability, indemnity and governing law, will continue to apply.
17. Changes to these Terms
We may update these Terms as the service changes. When a change is material we will tell you in the app or by email before it takes effect. Continuing to use Enchanted Connections after a change takes effect means you accept the updated Terms. If you do not agree, stop using the service and cancel your membership.
18. Governing law and disputes
These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law rules, and the courts of that jurisdiction have exclusive jurisdiction over any dispute, unless the mandatory consumer law where you live gives you the right to bring proceedings in your own courts. Nothing in these Terms limits rights you have under mandatory consumer protection law.
